Terms of Service

1. Definitions

• Service: The Goloris platform, tools, and related infrastructure.
• User: Any individual or entity registered to create and manage applications via the Service.
• Content: Any data, information, media, or software components uploaded, generated, or transmitted by the User.
• Third-Party Providers: External services or platforms integrated with or used in connection with the Service.

2. Scope of Service

Goloris enables Users to build Progressive Web Apps (PWAs) and iOS/Android applications using drag-and-drop components.

• Applications may be published under Company developer accounts on app stores, but intellectual property rights and responsibility for the app’s content remain solely with the User.
• The Service may connect to Third-Party Providers (e.g., for scheduling, e-commerce, analytics, authentication). Any exchange of data through such providers is solely the User’s responsibility.
• The Company does not guarantee availability, compatibility, or continued support of any integration with Third-Party Providers.

3. Accounts and Security

• Users must provide accurate and complete information when registering.
• Users are solely responsible for safeguarding their account credentials.
• Account sharing is strictly prohibited. Accounts found to be shared may be suspended without refund.
• The Company is not liable for unauthorized access caused by User negligence.

4. Acceptable Use

Users agree not to:

• Use the Service for unlawful purposes.
• Host, distribute, or promote content that infringes third-party intellectual property, contains adult material, malware, or spam.
• Attempt to reverse engineer, hack, or disrupt the Service.

Violations may result in immediate account suspension or termination without refund.

5. Pricing and Payment

• Goloris offers two subscription plans:

  • Free Plan: $0/month
  • Premium Plan: $10/month
• Payments are securely processed by authorized payment processors Paddle or LemonSqueezy.
• Prices exclude VAT and other applicable taxes. Taxes are applied based on the User’s country of residence.
• Subscriptions renew automatically unless canceled before the renewal date.
• If payment fails, the Company will retry for 7 days. After 7 days of unsuccessful attempts, the account will be downgraded to the Free plan.

6. Intellectual Property

• The Service, including its software, designs, and infrastructure, remains the exclusive property of the Company.
• Users retain ownership of the Content they input into their applications. However, the applications themselves are generated via the Service and remain licensed, not sold.
• Users grant the Company a limited license to host, transmit, and process Content solely for the purpose of operating the Service.

7. Third-Party Providers

• The Service may rely on or provide access to Third-Party Providers.
• The Company is not responsible for availability, performance, or legal compliance of such providers.
• Users are responsible for complying with the terms of any Third-Party Providers they choose to connect with.

8. Termination and Suspension

We may suspend or terminate accounts if:

• Payments are not made,
• These Terms are violated,
• Illegal or abusive use of the Service occurs,
• Account sharing is detected.

Users may cancel subscriptions at any time. Cancellation takes effect at the end of the current billing cycle. Refunds are only provided as described in our Refund Policy.

9. Disclaimers

• The Service is provided “as is” and “as available”.
• We do not guarantee uninterrupted availability, error-free operation, or suitability for a particular purpose.
• To the maximum extent permitted by law, all implied warranties are disclaimed.

10. Limitation of Liability

• The Company shall not be liable for indirect, incidental, or consequential damages.
• In any case, liability is limited to the amount the User paid for the Service in the preceding twelve (12) months.

11. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. However, for Users residing outside Türkiye, the mandatory consumer protection laws of the User’s country of residence shall prevail.

12. Changes to Terms

We may update these Terms periodically. If material changes occur, we will notify Users via email or in-app messages. Continued use of the Service constitutes acceptance of the updated Terms.

13. Miscellaneous

• Severability: If any provision is found invalid, the remaining provisions remain enforceable.
• Assignment: Users may not assign rights or obligations under these Terms without prior written consent.
• Entire Agreement: These Terms, along with the Privacy Policy and Refund Policy, form the entire agreement between the Company and the User.
